These Terms of Use (“Terms”) govern your access to and use of Apper — our website, application, and related AI-powered app-building features and services (collectively, the “Service”). By creating an account or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you may not access or use the Service.
1. Who May Use the Service
You must be at least 13 years old to use Apper. By using the Service, you represent that you meet this age requirement and that you will provide accurate, current, and complete information when registering for an account. You agree not to use the Service in violation of these Terms or any applicable law.
2. License
Subject to your compliance with these Terms, Apper grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or professional development. You may not:
  • Resell, sublicense, or otherwise provide access to the Service to any third party;
  • Reverse engineer, decompile, or scrape the Service or its underlying code; or
  • Interfere with, disrupt, or place an unreasonable load on the Service or other users' access to it.
3. Your Content & AI Usage
You retain ownership of the content you create using Apper, including your prompts, feedback, and the applications you generate (“Your Content”). By using the Service, you grant Apper a license to store and process Your Content as needed to operate and deliver the Service, and to use anonymized, aggregated data derived from Your Content to improve Apper and its underlying AI systems.
You may delete your account and Your Content at any time through your account settings or by contacting support. Where we use data for improving prompts, Apper etc, we use only anonymized logs for internal analysis. We do not use your content to train AI models.
4. Payments, Subscriptions & Payment Processing
Apper may offer paid subscription plans or one-time purchases that unlock additional features or content. Current pricing is shown on our purchase pages and may be updated from time to time.
Paid subscriptions automatically renew for successive billing periods (monthly or annual, as selected) unless you cancel before the end of your current billing period. You can cancel at any time through your account settings; cancellation takes effect at the end of the then-current billing period, and you will retain access to paid features until that date.
Payment processing. All payments made through Apper are processed by Paddle.com Market Limited (“Paddle”), our authorized payment processor and merchant of record. Paddle collects and securely stores your payment information — including card, billing, and related financial details — directly, and processes payments on our behalf. Apper does not receive, store, or have access to your full payment card or bank account details; we receive only confirmation that a payment has been made. Your use of Paddle's payment services is also subject to Paddle's own terms of service and privacy policy.
5. Refund Policy
We do not offer refunds on paid trials. Once you convert to or purchase a paid trial, that payment is final and non-refundable.
For recurring subscriptions (monthly or annual plans billed on an ongoing basis), you may request a refund within 14 days of the applicable charge. Refund requests made after this 14-day window will not be honored, except where required by applicable law.
To request a refund, contact us at [email protected] with your account details and the date of the charge. Approved refunds are returned to the original payment method via Paddle.
6. Termination
We may suspend or terminate your account if you violate these Terms, attempt to disrupt, scrape, or overload our systems, or engage in abusive or unlawful behavior. You may delete your account at any time through your account settings or by contacting support. Upon termination, your right to access and use the Service ends immediately, though certain provisions of these Terms (including Intellectual Property, Disclaimers, and Limitation of Liability) will survive.
7. Intellectual Property
Apper retains all rights, title, and interest in its branding, platform design, and underlying source code. You may use content you generate using the Service for your own purposes, but you may not copy our user interface or branding, replicate the Service's functionality for resale, or impersonate Apper.
8. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of reliability, uptime, or fitness for a particular purpose. AI-generated outputs are probabilistic in nature and may be inaccurate, incomplete, or unsuitable for your intended use; you are responsible for reviewing and testing any output before relying on it.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Apper will not be liable for any lost profits, business interruption, loss of data, or errors or inaccuracies in AI-generated content, whether arising in contract, tort, or otherwise, even if we have been advised of the possibility of such damages.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles, and any disputes arising from or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Nashik, Maharashtra, India.
11. Changes to These Terms
We may revise these Terms from time to time. We will notify you of material changes by posting an update on our website, within the app, or by email. Your continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.
